There's a whole lot of confusion and misinformation about the legalities of public breastfeeding. As the conversation continued and everyone chimed in with their thoughts, a lot of people say it's illegal in OK.

About half the people at the water cooler talking over the topic thought it was illegal. They also assumed that you could be arrested and charged with indecent exposure or some other criminal or misdemeanor offense.

EACH STATE HAS ITS OWN LAWS THAT ADDRESS BREASTFEEDING IN PUBLIC

As it turns out it's completely legal in all 50 states to breastfeed in public. The last 2 states to pass legislation to protect nursing mothers and breastfeeding in public were Utah and Idaho so it's Nationwide.

It is completely legal in Oklahoma to breastfeed in public see Title 63, Section 1-234.1

As mentioned above each state has its own laws regarding breastfeeding in public including Oklahoma. Legislation was passed back in 2004 to amend Oklahoma Statues Tile 63 Public Health and Safety.

OKLAHOMA STATE LAW PROTECTS THE RIGHTS OF NURSING MOTHERS

The Sooner State has taken steps to ensure nursing mothers' rights and the right to breastfeed in public. You'll find 63-1-234.1. Breast-feeding – Declaration as right on page 142 of the Oklahoma Statutes.

Here's the actual law quoted directly from the statutes: The Legislature hereby declares that breast-feeding a baby constitutes a basic act of nurturing to which every baby has a right and which should be encouraged in the interests of maternal and child health. In furtherance of this right, a mother may breast-feed her baby in any location where the mother is otherwise authorized to be. Breast-feeding shall not constitute a violation of any provision of Title 21 of the Oklahoma Statutes. Added by Laws 2004, c. 332, § 1, emerg. eff. (05-25-04).

CAN A STORE OR BUSINESS KICK YOU OUT FOR BREASTFEEDING IN PUBLIC? SEE BELOW

So now you know, yes it's completely legal in Oklahoma to breastfeed in public. Now I know what you're thinking. What about the possibility of getting kicked out of a store, business, or other places for doing so? Well, there's a really good chance that any place which is open to the general public that kicks you out for breastfeeding your baby in public could face being sued along with other actions and possible civil litigation.
